Newsletter & Sending Terms

1. Overview & Your Role
These Newsletter & Sending Terms ("Sending Terms") govern your use of BookAuth's newsletter and email-sending features. They apply to authors and others who send newsletters, campaigns, or other commercial or bulk electronic messages through the platform.
You are the "sender" and the data controller of the subscribers to whom you send. BookAuth acts as your technical service provider / processor, sending messages on your behalf. You are responsible for ensuring you have the lawful right and consent to send to every address you use. Our processor obligations are in our Data Processing Addendum.
These Sending Terms are incorporated into our Terms of Service and, where you also sell, the Seller Agreement.
2. Consent Is Your Responsibility
You may only send commercial or promotional emails to subscribers who have given valid consent under all applicable laws, including:
- CAN-SPAM Act (U.S.): every commercial email must include your valid physical postal address, accurate "From"/header information, a clear subject line, and a functioning unsubscribe mechanism. You must honor opt-out requests within 10 business days.
- CASL (Canada): you must have express or implied consent for each Canadian recipient, identify yourself and anyone on whose behalf you send, include your postal address and contact information, and provide a working unsubscribe link that remains valid for at least 60 days. Express consent must be captured without pre-checked boxes, and you must keep records of consent (date/time/source/manner).
- GDPR / UK GDPR / ePrivacy (EEA, UK): for recipients in these regions, you must have a lawful basis — typically freely-given, specific, informed, and unambiguous consent for marketing — and you must be able to demonstrate it.
- Other jurisdictions: comply with any local anti-spam or electronic-marketing law that applies to your recipients.
You must not: send to purchased, rented, scraped, or appended lists; send to addresses obtained under false pretenses; suppress or hide unsubscribe links; continue emailing after an opt-out; or use BookAuth to send to anyone who has not consented to receive messages from you.
BookAuth may enable and require confirmed (double) opt-in for new subscriptions. Where enabled, you should use it — it produces the strongest consent record.
3. Anti-Spam Policy & Acceptable Sending
In addition to Section 2, you agree that you will not:
- Send unsolicited, deceptive, misleading, or fraudulent emails;
- Use misleading subject lines, "From" names, or headers;
- Falsify sender information or use someone else's identity;
- Send content that violates our Acceptable Use Policy or applicable law;
- Use mechanisms to circumvent our unsubscribe handling or bounce processing;
- Send to role-based, unknown, or recycled addresses you have no relationship with;
- Overwhelm recipients or send at a volume your audience has not consented to.
BookAuth monitors sending health (bounces, spam complaints, unsubscribes) to protect deliverability for all senders. We may throttle, pause, or suspend sending for any account whose metrics indicate spam, abuse, or poor list hygiene, with or without notice. We may require list re-confirmation or removal of problematic addresses.
4. Subscriber Data & Processing
- Your subscribers' data. You control your subscriber list and are responsible for lawful collection, consent records, and honoring data-subject requests (access, deletion, etc.). BookAuth processes this data on your behalf per our Data Processing Addendum.
- Collection points. Subscribers join through subscription forms you place, the platform's reader features, or your author site. You must ensure each collection point discloses what subscribers are signing up for.
- Transfers to your other tools. If you export subscribers to other platforms, you remain responsible for consent and lawful transfer at the destination.
- Security. You must keep your account credentials secure and are responsible for use of your sending privileges.
5. Unsubscribes & Transactional Mail
Every commercial email must include a working unsubscribe link that we (or you) process. "Transactional" messages (e.g., order receipts, delivery of purchased products) related to an existing relationship are not marketing, but you must still ensure they are not used to send promotional content to people who have opted out of marketing.
6. Enforcement, Liability & Indemnification
You are solely responsible for the legality of your lists and messages and for any complaints, claims, regulatory action, or damages arising from your sending activity, including statutory penalties under CAN-SPAM, CASL, or GDPR. You agree to indemnify and hold BookAuth harmless from such claims. BookAuth may suspend or terminate sending access for violations and may take action to protect the platform's sending reputation. BookAuth's liability is limited as provided in the Terms of Service.
